Children Under the Age of 13

The Website and our services are directed to businesses and their authorized representatives and are not intended for anyone under 18 years of age. Text Messaging (SMS/MMS) Program

If you provide your mobile telephone number and opt in to receive text messages from Fox, we may send you SMS or MMS messages relating to your inquiry, application or account, including application status updates, account servicing notifications, customer care messages and, where you have separately consented, marketing and promotional messages.

Consent and Opt-In. We send text messages only to individuals who have provided prior express consent to receive them, whether through our online forms, by texting a keyword to us, or through another documented opt-in method. Consent to receive text messages, including marketing text messages, is not a condition of obtaining funding or of purchasing any goods or services from Fox. Message frequency varies. Message and data rates may apply.

Opt-Out. You may opt out of receiving text messages from us at any time by replying STOP to any message you receive from us, by using any other reasonable method of revoking consent (such as replying “stop,” “quit,” “end,” “revoke,” “opt out,” “cancel” or “unsubscribe”), or by contacting us at privacy@foxbusinessfunding.com or (800) 895-4424. We will honor opt-out requests promptly and in any event within ten (10) business days. After you opt out, you may receive a single message confirming your opt-out, after which we will send you no further text messages unless you opt back in.

No Sharing of Mobile Information. No mobile information will be shared with, or sold to, third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the text message services acting on our behalf solely to deliver the messages you have requested, and those parties are prohibited from using the information for any other purpose. This paragraph applies regardless of any other provision of this privacy policy.

Carriers. Wireless carriers are not liable for delayed or undelivered messages.

Bank Account Verification

From time to time, we may ask you to verify your bank account information on pages
hosted by our Website in order to effectively carry out some of our services. Such bank
account verifications are processed by a third-party integrator, Plaid. All information
provided in connection with the bank account verification process is governed by Plaid’s
Privacy Policy and Terms and Conditions of Use, which can be accessed from Plaid’s
website. Fox does not use or store your banking information for any purpose.

Aggregate/Anonymous data

We may aggregate, de-identify and/or anonymize any information collected through the Website so that such information is no longer linked to your personally identifiable information (such as your name, address, phone number or email address).  We may use and share aggregated and anonymized information for any purpose, including without limitation, for research and marketing purposes, and may also share such data with any third parties, including advertisers, promotional partners and others.

Disclosure of Your Information 

To make the Website and our services available, we may need to share your personal information with third parties and service providers who perform services on our behalf. This section explains when and why we share your information.

We may disclose aggregated information about our users and information that does not identify any individual, without restriction. In addition, and except as provided in the Text Messaging (SMS/MMS) Program section above with respect to mobile information, we may disclose personal information that we collect or you provide:

  • To our subsidiaries and affiliates; 
  • To third-party service providers. For example, we may share your personal information with credit reporting services when we request a credit report regarding you, and to other potential sources of funding you identify to us. We may share your personal information with third parties who assist us with customer support services, who provide IT services, and who otherwise help us provide, maintain and improve our services; 
  • To collection agencies, in order to collect on delinquent accounts; 
  • To respond to claims that any posting or other content violates the rights of third parties; 
  • To investigate, prevent, defend against, or take other action regarding violations of our Terms of Use, illegal activities, suspected fraud, or situations involving potential threats to the legal rights or physical safety of any person or the security of our Website and services offered by our Website. 
  • In connection with a transaction or proposed transaction involving the transfer of substantially all of the assets of Fox or one or more of its businesses to another entity, whether an affiliate or a third party, in connection with a bankruptcy or liquidation;

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

Mobile Information. As described in the Text Messaging (SMS/MMS) Program section above, no mobile information, including text messaging opt-in data and consent, will be shared with or sold to any third parties or affiliates for marketing or promotional purposes, and mobile opt-in data is used solely to deliver the messaging you have requested.

Promotional Offers from the Company. If you do not wish to have your contact information used by Fox to promote our own or third parties’ products or services, you can opt-out by sending us an email stating your request to privacy@foxbusinessfunding.com or, for text messages, by replying STOP to any message as described above. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt out does not apply to information provided to the Company as a result of a product service experience or other transactions.

Targeted Advertising. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers’ target-audience preferences, you can opt-out by sending us an email stating your request to privacy@foxbusinessfunding.com.

We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website.

We do not “sell” or “share” your Personal Information, as those terms are defined under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA”), and we have not sold or shared your Personal Information in the preceding twelve (12) months. Nevada residents who wish to exercise their sale opt-out rights under Nevada Revised Statutes Chapter 603A may submit a request to this designated request address: privacy@foxbusinessfunding.com.   However, please know we do not currently sell data triggering that statute’s opt-out requirements.

Accessing and Correcting Your Personal Information

You may send us an email at privacy@foxbusinessfunding.com to request access to, correct or delete any personal information that you have provided to us. We may retain certain personal information as required by law or for legitimate business purposes, and in some cases we cannot delete your personal information except by also deleting your account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Your California Privacy Rights

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls. 

The safety and security of your information also depends on you.
